What Is The Charge For An Open Container? I Got Cited In Lancaster Ca For An Empty Beer Can.?

So I was on my way back home from my buddies house and I was initially stopped for my “tinted” windows. The cop asked if I had anything illegal in the car I said “NO” so he says he’s going to search the car, so he does and he finds a freaken can that one of my “buddies” left in my car earlier so I also got screwed for an open container…so he took a picture of the can on top of the car as proof I guess, because I told him I wasn’t going to hold the can…he wanted me to hold the can so he could take a picture i said “HELL NO” it’s not my can…anyways I was curious if I would be charged with a fine or what….I have no criminal record all I gotten in the past is one speeding ticket and that’s it…thank you..

    I will respectfully disagree with the poster above me. If you have an empty beer can with a half inch of dust in it, it is still an open container. No alcohol need be present what so ever.
    In Ohio, that is punishable by a $250 fine.
    Tell your “friends” to throw out the containers. Or better yet, dont allow any drinking in your car. Even in your driveway.

    If the can was empty as you say then there is no open container to speak about. The only way you can be charged with an open container is that the container must contain some liquor in it period. You should definitely fight the charge and don’t flinch. Stand your ground…….

    I don’t know about cali, but in Massachussetts it’s a $500 fine. thats it. No loss of license or anything like that.
    It is either going to be 250 or 500 dollars. Thats what I would say.
